- We share mobile messaging data with our messaging service provider (Klaviyo) solely to operate the Program. Carriers supporting our Program are not liable for delayed or undelivered messages.
We do not sell or rent your SMS consent status or personal data collected through the Program to third parties.
Behavioural Advertising
We use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. For example, we share information about your use of the Site, your purchases, and your interaction with our ads on other websites with our advertising partners. We collect and share some of this information directly with advertising partners, and in some cases through cookies or similar technologies (which you may consent to depending on your location). Lawful Basis
If you are a resident of the European Economic Area (EEA), we process your personal information under the following lawful bases: (1) your consent; (2) performance of the contract between you and the Site; and (3) our legitimate interests, which do not override your fundamental rights and freedoms.
Retention

Automatic Decision-Making
We do not engage in fully automated decision-making that has a legal or otherwise significant effect using customer data. Our processor Shopify uses limited automated decision-making to prevent fraud (e.g., temporary denylists of IP addresses associated with repeated failed transactions), which do not have a legal or otherwise significant effect on you.
Cookies and Tracking Technologies
Cookies are small data files downloaded to your computer or device when you visit our Site. We use functional, performance, advertising and social media cookies to remember your preferences and improve your experience. Session cookies last until you stop browsing; persistent cookies last until they expire or are deleted. You can control cookies via your browser settings. Cart Reminder Tracking: We use cookies, pixels or similar tracking technologies to monitor items you add to your cart and determine when to send cart-reminder SMS messages. This tracking allows us to send you timely reminders about products you left in your cart. These cookies do not collect sensitive personal information but may link browsing behaviour to your phone number for the sole purpose of sending you cart reminders. You can manage these cookies through your browser settings or by opting out of cart-reminder messages via the Program.
Text and Marketing Notifications (Updated)
By entering your phone number at checkout, subscribing via our sign-up form or keyword, you consent to receive recurring service-related messages (e.g., order updates, account alerts) and promotional messages(e.g., promotions, specials, cart reminders). Consent is not a condition of purchase. Messages may be sent using an automatic telephone dialling system, and message frequency may vary. Message and data rates may apply. Do Not Track
Because there is no consistent industry understanding of how to respond to Do Not Track signals, we do not alter our data collection and usage practices when we detect such a signal.

Dispute Resolution and Class Action Waiver

Mobile Program Terms and Conditions

These Mobile Program Terms and Conditions govern your participation in the FarmHouse Fresh mobile message service (the Program). By opting into the Program, you agree to these terms. We may modify or cancel the Program or its terms at any time; your continued participation constitutes acceptance of any changes.
Program Description
The Program allows us to send service-related messages and promotional messages to your mobile device:
- Service-related messages: Updates, alerts and information (e.g., order updates, account alerts, shipping notifications).
- Promotional messages: Promotions, specials and other marketing offers (e.g., sweepstakes, cart reminders, sale announcements).
Consent
By providing your phone number and opting into the Program (e.g., by checking a box, responding to a keyword or entering your number at checkout), you consent to receive recurring SMS/text messages from and on behalf of FarmHouse Fresh via your wireless provider to the mobile number you provided, including messages sent using an automatic telephone dialling system. Consent is not a condition of purchase. You must be 18 years or older to participate.
Costs and Message Frequency
We do not charge for the Program, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply. Message frequency varies—you may receive multiple messages per month depending on your interactions and subscriptions.
Opt-Out and Help
You may opt out of the Program at any time by replying STOP to any message or using the unsubscribe link (where available). You will receive a one-time confirmation text. No further messages will be sent unless you re-initiate contact. To receive help or assistance, reply HELP or contact Customer Care at 1-888-773-9626 ext 2 or customercare@farmhousefreshgoods.com.
Mobile Service Providers and Liability
The wireless carriers supported by the Program are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number and promptly update us if the number changes. To the extent permitted by law, we are not liable for failed, delayed or misdirected delivery of information sent through the Program.
Privacy
We respect your privacy. Please see our updated Privacy Policy for information on how we collect and use your Personal Information. We will not share or sell your SMS opt-in data or consent with third parties for their marketing purposes.
State Law Compliance
We endeavour to comply with relevant state telemarketing laws. For example:
- Florida Telemarketing Act and Do Not Call Act: We assume you are a Florida resident if your shipping address or area code is in Florida. Mobile messages sent in direct response to your messages (e.g., response to keywords, opt-in, help or stop requests and shipping notifications) are not considered “telephonic sales calls” under Florida law.
- Washington Revised Code: We assume you are a Washington resident if your area code is in Washington. We comply with commercial telephone solicitation requirements to the extent applicable.
- Oklahoma Telephone Solicitation Act of 2022: We assume you are an Oklahoma resident if your area code is in Oklahoma. Mobile messages sent in direct response to your messages are not considered “telephonic sales calls” under Oklahoma law.
You agree to notify us in writing if you are a resident of a different state and the above assumptions do not apply to you.
Dispute Resolution and Class Action Waiver
Any dispute arising from the Program will be resolved by confidential arbitration, not in court. An arbitrator will decide the dispute and the arbitrator’s decision may be confirmed by a court. Both parties waive the right to proceed in a class action or to consolidate claims. If a court finds the class-action waiver unenforceable, the arbitration agreement will be void.
Changes to Terms
We may modify these Mobile Program Terms at any time. The updated version will be posted on our Site. Your continued participation in the Program constitutes acceptance of the updated terms.
